Bankrupt Yorkshire Waste Operator Faces Suspension for Illegally Directing Companies
A Yorkshire waste management operator has been penalised for unlawfully serving as a director while under bankruptcy restrictions. Jonathan Waldron, 44, was sentenced at York Crown Court, receiving a suspended prison term of 16 months along with additional penalties for his actions.
Illegal Directorships Uncovered
Waldron, of Winton, Northallerton, North Yorkshire, was declared bankrupt in October 2021. Despite this ruling, investigations by the Insolvency Service revealed that he continued to manage several companies, including Selective Environmental Solutions Limited, Thompson Recycling LLP, Pintail Nest Farm Limited, and Go Crushing & Screening Limited.
During his bankruptcy, Waldron persisted in his role as director of multiple enterprises, a clear violation of legal regulations designed to protect creditors. The Insolvency Service has stringent laws preventing bankrupt individuals from acting as directors to prevent further financial mismanagement.
Legal Consequences
As part of his sentence, Waldron will complete 200 hours of unpaid community service and pay legal costs amounting to £1,000. Additionally, he is barred from serving as a company director for five years.
David Snasdell, Chief Investigator at the Insolvency Service, stated that Waldron’s actions display a complete disregard for the law. “Bankruptcy restrictions exist to protect creditors and the wider business community from individuals who have demonstrated they cannot manage companies responsibly,” he noted, reinforcing the severity of the offence.
Details of the Violations
Waldron remained on the register of directors for Selective Environmental Solutions Limited despite receiving multiple notifications from Companies House regarding his requirement to resign. Investigations revealed his involvement in management-related decisions at Thompson Recycling LLP, where his LinkedIn profile even promoted his directorship.
Furthermore, evidence demonstrates that Waldron also served as a director for Pintail Nest Farm Limited as recently as July 2023, continuing to file company documents while still under bankruptcy restrictions. In another instance, he acted as the sole director of Go Crushing & Screening Limited, ultimately dissolving the company in May 2023.
Future Restrictions
Waldron is set to remain disqualified from acting as a company director until January 2031. Although he is scheduled to be discharged from bankruptcy by March 2025, the consequences of his actions will linger long after his financial status is officially resolved.
