Brandon Smith’s Sentence Increased Following Court Appeal
Brandon Smith, a 25-year-old from Denton, Greater Manchester, has had his prison term extended by four and a half years after his case was reviewed by the Court of Appeal. The increase comes under the Mitigating Sentences scheme, following Smith’s conviction for multiple sexual offences, including rape.
Details of the Offence
The court was informed that Smith had been surveilling his victim for six months prior to the assault. On the morning of 5 July 2024, he confronted her during her commute, brandishing a knife and threatening to stab her if she resisted. He then proceeded to drag her behind some bushes and sexually assaulted her.
Following the attack, Smith issued threats against the victim’s mother, warning that she would be harmed if she reported the incident. Throughout the trial, Smith denied his involvement, initially claiming he had never encountered the victim. However, he later changed his narrative to assert that the encounter had been consensual after forensic evidence disclosed his presence at the scene.
Court Proceedings and Sentence Enhancement
On 8 January 2025, Smith was convicted of five serious charges, including rape and sexual assault, at Bolton Crown Court. Initially, he received a sentence of 12 years and six months, coupled with a three-year licence extension, as well as a restraining order.
However, on 21 November 2025, this sentence was escalated to 17 years with an additional three-year licence extension, following a referral to the Court of Appeal under the Unduly Lenient Sentence scheme.

In a statement, Solicitor General Rt Hon Ellie Reeves MP condemned Smith’s actions as “utterly appalling.” She reaffirmed the Government’s commitment to reducing violence against women and girls, expressing gratitude for the court’s decision to extend Smith’s sentence in order to protect the public from a dangerous offender.
